Court clears way for demolitions in Ahmedabad

GANDHINAGAR - The Gujarat High Court Monday allowed the Ahmedabad Municipal Corporation to resume a drive to seal buildings with illegal construction in the C.G. Road area under its jurisdiction.

The bench of Chief Justice S.J. Mukhopadhaya and Justice Akil Kureshi while vacating a stay granted against sealing action observed that the C.G. Road Shop Owners Association failed to comply with the directions earlier passed by the court.

It is discriminating that only the shops of owners on C.G. Road have been excluded from getting sealed. Despite getting so many opportunities even after non-compliance, theyve again failed to comply with the courts order and directives, the chief justice said.

You have been allowed time earlier to provide the parking space as required by the law. Despite the interim relief granted earlier, youve still not done anything, the bench said.

Taking a serious note of money being collected from shop owners in name of the courts order, the bench said: You cannot collect money like this. We have received a complaint on administrative side in this regard. This cannot be tolerated.

After vacating the stay, the bench also asked the civic body to carry on with its drive to comply with the courts earlier order to act against unauthorized constructions in Ahmedabad.
