High court cancels Gujarat official’s promotion

GANDHINAGAR - The Gujarat High Court Tuesday cancelled the promotion of Director (Environment) J.K. Vyas, terming it “unconstitutional”.

Justice M.R. Shah passed the order on a petition filed by environmentalist Amit Jethava.

The petitioner had submitted before the court that Vyas was promoted from the post of senior technical officer to the post of director (environment), which comes under the forests and environment department.

He said that the department did not consult the Gujarat Public Service Commission (GPSC) before the promotion.

According to the petitioner, the constitution is clear that the public service commission’s consultation is mandatory in recruitment or promotions in the civil services.

The petitioner claimed that Vyas’ promotion was “unconstitutional”.

Earlier, the high court had issued notice to the government, the GPSC and Vyas.
