Retrial of Ala.’s drug overpricing lawsuit delayed

MONTGOMERY, Ala. — The retrial of Alabama’s prescription drug overpricing lawsuit against California-based Watson Pharmaceuticals has been delayed.

The original trial of the state’s case against Watson of Corona, Calif., ended in July in a mistrial when jurors were unable to reach a verdict after deliberating for more than 7 hours.

The case had been scheduled to be retried this week along with the state’s lawsuit against Mylan Pharmaceuticals of Morgantown, W.Va.

Montgomery Circuit Judge Charles Price rescheduled the trial of the lawsuit against Watson until Dec. 7. He said the lawsuit against Mylan would be tried in January.

The judge has been encouraging all sides to discuss possible settlements of the cases.
