GANDHINAGAR - The Gujarat High Court Tuesday sought the response of police on the plea of a minor girl for the court’s intervention for an abortion after she was raped and became pregnant.
Hearing the petition of the 13-year old who said she had been raped repeatedly over a year by a neighbour, Ghanshyamsinh Rajput, and was pregnant, Justice Anant Dave issued notice to the investigating officer of the case.
When her mother came to know about the rape induced pregnancy, she lodged a complaint and Rajput was arrested. However, when the family approached a local doctor for carrying out an abortion, he refused, stating that police or the court’s permission would be required.
A sessions court in Dhrangadhra town of Surendranagar district was approached for permission but the family’s plea was rejected March 30. They then approached the high court.
The court was told that the girl was two months pregnant and was in no position to take responsibility of a child.
