GANDHINAGAR - Nirma Industries Ltd. Wednesday proposed before the Gujarat High Court that it can release 46 hectares of land allotted for its cement plant after petitioners alleged that the land for the proposed project was on a river bed.

The proposal came after a division bench of Chief Justice S.J. Mukhopadhya and Justice Akil Kureshi observed the evidence on record that stated total 100 hectares out of the allocated 268 hectares near Mahuva in Bhavnagar district be given back as it

constitutes a reservoir.

A public interest petition filed by BJP legislator of Mahuva, Kanu Kalsaria, said the submerged land was on the riverbed and the water body was useful to villagers and farmers.

Two different reports by experts committees had mentioned that 100 hectares of the land constitutes a water body. Thereafter, the state government had taken back 54 hectares of land.

The next hearing is scheduled for April 6.
