Casey Anthony asking that murder charge be dropped

ORLANDO, Fla. — A prosecutor has asked a judge to dismiss a request to throw out the most serious criminal charges against a Florida mother accused of killing her 2-year-old daughter.

The motion filed by Casey Anthony’s attorneys is insufficient and riddled with errors, prosecutor Linda Drane Burdick said Friday during a brief hearing.

Circuit Judge Stan Strickland didn’t immediately rule on the prosecutor’s request. Anthony’s attorneys argued Friday that their motion to throw out the first-degree murder and aggravated child abuse charges needed to be considered. In an earlier filing, they said the charges were based on “circumstantial and speculative” evidence.

Anthony has pleaded not guilty and says a baby sitter kidnapped Caylee. The toddler’s remains were found in December 2008, months after she was reported missing.
