SD prosecutors charge 2 for 1975 AIM slaying

SIOUX FALLS, S.D. — State prosecutors say a Canadian man has been charged with murder in the 1975 killing of a fellow American Indian Movement member.

South Dakota prosecutors said Thursday that John Graham and a Rapid City woman, Thelma Rios, have been indicted on murder charges in the killing of Canadian Annie Mae Aquash (AH’-kwash) near Wanblee, S.D.

Graham had faced federal murder charges in Aquash’s killing but two courts ruled the U.S. government lacked jurisdiction to try Graham because he is not American Indian. Federal prosecutors say they may appeal.

A second man, American Richard Marshall, is still charged in federal court in Aquash’s killing.
